Kim McClain, a California resident, came to Colorado for the first time this month to pick up the ashes of her dead three-year-old daughter, Alexis. Her ex-boyfriend, Mark Weeks, and his wife Ginger were indicted by a Colorado grand jury on July 19 for Alexis's death, being charged with first-degree murder and reckless and knowing child abuse.
McClain and Weeks first met in San Diego, where she became pregnant with Alexis. Weeks and Ginger, then his girlfriend, actually took her to the hospital when she went into labor. Weeks was thereafter awarded custody of Alexis. Child custody was "a long story," says McClain. "It was just San Diego and they screwed up on a lot of stuff. The court system just wasn't very justifiable out there."
Weeks received custody in July 2009 and moved to Kansas, but relocated thereafter to Sterling. McClain's subsequent contact with the child was minimal. "I think the longest conversation I was able to have with her was when she counted from zero to 10 for me, you know and told me she loved me. And then she did her ABC's."
McClain says that Weeks and his wife never told her anything about her daughter. She says that, had she known of anything out of the ordinary, "I would've fought for her."
She says that Weeks is antagonistic toward her and aimed an obscene gesture her way after leaving court following the indictment. Logan county deputies stated that several other people saw the gesture. The deputies said that the case is the "most horrific" they have seen.
